Yes, in full. Since 1 October 2023, Section 156 of the Building Safety Act 2022 requires every responsible person to record the complete fire risk assessment in writing, whatever the headcount and whether or not the premises holds a licence. The name of anyone engaged to make or review the assessment must be recorded too. What Section 156 requires covers the duty in detail.

The officer asks for documentation before walking the building: the written fire risk assessment, the fire logbook, drill and training records, weekly alarm and monthly emergency lighting test logs, and extinguisher and alarm maintenance certificates. A document you can't produce on the day gets noted, and producing it afterwards is unlikely to change what was recorded. In 2024/25, English fire services completed 51,026 audits and only 58% were found satisfactory. What happens during an inspection walks through the visit.

A statutory process starts. An enforcement notice sets out the failures to remedy within a minimum 28-day period, and non-compliance is a criminal offence. A prohibition notice can restrict or close the premises immediately where the risk is imminent. The typical enforcement notice lists six separate breaches; a missing fire risk assessment rarely appears alone. The notice types and their clocks explains the sequence.

Between 2023 and 2025, court data recorded 35 organisation fine outcomes under the Fire Safety Order in England and Wales: median fine £25,000, mean £50,570, and main offences carry unlimited fines. In 17 of 34 hospitality and commercial cases in our file, the published record shows a breached or unfinished notice, an incomplete action plan, or an unanswered statutory request. Eight ended with a prison sentence for an individual. Every sentence was suspended. Our prosecution case file has the full record.

The statutory test is Article 18 of the Fire Safety Order: sufficient training and experience or knowledge and other qualities. No named qualification and no register. A publican can assess a simple premises themselves, and third-party schemes such as BAFE SP205 remain voluntary. Article 9A, which will make competence of an appointed assessor a duty in its own right, is on the statute book but not yet in force. Where assessor competence stands tracks the moving parts.
