What do OHSA convictions cost in Ontario?
Across 335 convictions announced in Ministry court bulletins since June 2018, the median base fine is $80,000, and the mandatory 25% victim surcharge takes the typical bill to $100,000. A third of prosecuted cases involved a worker's death, and those carry a median $130,000 base fine, double the non-fatal injury figure. 2025 was the busiest enforcement year on record. What happens after a critical injury or fatality?
The Ministry must be notified immediately, with a written report within 48 hours, and WSIB within three business days. The scene is frozen by law: nothing is disturbed without the inspector's permission except to save a life, relieve suffering, or prevent further damage, and an inspector can stop work in the affected area.
